Section 20
Request for extradition from a foreign state

(1) If any person who has been charged or found to have committed any offense within Nepal is residing in any territory within the jurisdiction of a foreign state or is in transit of that state while going to a third country, such fugitive accused or In order to extradite the offender, the ministry shall request the relevant foreign state through diplomatic channels.

(2) Notwithstanding anything written in sub-section (1), if there is a possibility that the fugitive accused or the escaped offender may disappear if not immediately arrested and detained. The ministry may directly request the foreign state to immediately arrest and take custody of the fugitive accused or criminal.

(3) When making a request according to sub-section (2), in the case of a fugitive accused, prima facie evidence of the accused and in the case of a criminal, the court or other The judgment passed by the competent body should also be attached.

(4) Based on the evidence and judgment as per sub-section (3), in case of the arrest of a fugitive accused or criminal from the relevant foreign state, such fugitive accused as soon as possible within seven days from the date of receiving the information about the arrest. Or the Ministry shall make a request to the concerned state through diplomatic channels for the extradition of the offender.

(5) Disclosure and attachment of the details and documents to be disclosed and attached in accordance with Section 8 when requesting for extradition in accordance with sub-section (1). will fall.
